Rental Terms & Conditions

Critical Rental Solutions (CRS or Critical Rental)

1. Pricing:

All rents are billed from the date CRS receives authorization to proceed or receives Purchase Order and when equipment is allocated to project. Rental period ends when all equipment has been returned to CRS yard in Houston, TX.

2. Payment Terms:

Pending further review at the time of order, payment terms are Net 30. Invoicing is generated based on a 28-day billing cycle/month. Equipment subject to minimum rental periods.

3. Equipment Usage:

Standard pricing allows unlimited equipment operation unless otherwise stated. Stated capacities and pressures are measured at the discharge flange of the compressor and do not account for hydraulic losses of the customers' system. Atmospheric conditions will impact the performance of the compressor packages. No performance guarantees are offered or implied.

4. Proposal Validity:

The terms of this proposal are VALID FOR 30 DAYS and are contingent upon equipment availability.

Additional Services

5. Freight:

Cost to deliver and return load(s) of equipment and accessories to and from your site are estimated and subject to change based on scheduled timing. Additional shipping and handling fees may apply.

6. Start-up and Commissioning:

All Critical Rental equipment shall be installed by the customer. Initial Start-up/commission of machinery requires a qualified Critical Rental technician or authorized representative at published rates. It is recommended that all 50 - 400 horsepower equipment be started and commissioned by a Critical Rental qualified technician. However, it is a requirement that all 500 horsepower and larger equipment be started and commissioned by a Critical Rental qualified technician. Customer should allow 1-3 business days for startup and commissioning per machine, once equipment is offloaded, placed, and leveled. All start-up/commissioning; set up; tear down or service calls will be charged at the following rates:

Domestic Labor Rate:

  • $305.00 per hour straight time (8am - 5pm Monday-Friday) 
  • $457.50 per hour overtime
  • $500.00 per hour holiday
  • Commissioning - $4,000.00 -start up and commissioning day rate - provides for travel and hours associated with the start-up and commissioning - Travel is defined as end-use location being 200 miles away or greater from our Houston facility.

International Labor Rate:

  • POR - pricing on request. 
7. After-hours Rental Fee:

A fee of $1,500.00 will be applied in the event of after-hours loading and off-loading. Warehouse hours are from 7 am - 4 pm (Monday - Friday)

8. Equipment Services:

It is the customer's responsibility to ensure the equipment is maintained and serviced throughout the project term, unless otherwise negotiated. If the customer carries out the maintenance and service, Critical Rental must receive a communication in writing as soon as the work is complete. The communication will need to include details of work carried out, parts used, any faults found, the date the work was performed and running hours of the equipment at the time of service. Service intervals and procedures can be provided upon request. NB: Failure to carry out daily checks and scheduled maintenance on the equipment within the recommended time periods may result in serious damage and can also create health and safety risk. Additional charges for damage may apply if due to lack of or incorrect servicing procedures. If Critical Rental performs the maintenance and servicing, charges for this work will be based on the rates contained in this proposal. All materials required for normal maintenance and any parts required that need to be replaced due to running conditions, neglect or theft, will be charged in addition to the above.

9. Environmental Fee:

An environmental fee of 5% will be charged on all equipment containing fuel, oil, refrigerant, or other fluids, liquids, or gases that could have an environmental impact. This includes generators, transformers, compressors, aftercoolers etc. Note that if the equipment subject to the fee is also subject to shift rates, the amount of the fee will vary in proportion to the applicable shift rate. The fee is NOT a tax or governmental charge. It is used to help offset expenses incurred operating in an environmentally sound manner. All heat exchangers which will come into contact with process contaminants will be subject to cleaning, certifying and waste-disposal charges. When renting a heat exchanger for process application, SDS for all possible contaminants must be provided.

10. Terms, Conditions and Customer Responsibilities
  • Delivery/Pickup standby time is billed at $150.00 per hour during delays.
  • Customer responsible for obtaining any relevant operating permits State and local taxes.
  • Tax-exempt customers must supply an exemption certificate.
  • Customers are responsible to provide any and all required union labor.
  • Full replacement insurance on equipment. (Certificate must be provided prior to delivery.) 
  • All lifting/off-loading of equipment. (as applicable)
  • Customer responsible for leveling equipment.
  • Customer responsible for motor alignment. (as applicable)
  • Customer responsible for electrical connections. (main and control)
  • Customer responsible for all piping connections. (water, air and control air)
  • Customer responsible for filling & evacuating turbine oil upon receipt and return. (as applicable)
  •  Oil must be approved by Critical Rental Solutions before filling. (as applicable)
11. Insurance

Customer shall provide to CRS and maintain throughout the term of the Agreement the following insurance in US Dollars (or such other currency as specified in the Agreement): (1) Workers Compensation/Work-related Injury Insurance: Statutory in accordance with the state in which the products are being used; (2) Employers Liability in the amount of $2 million each occurrence; (3) Commercial General Liability with limits of $2 million each occurrence, $2 million aggregate, for bodily injury and property damage combined, including the following coverage features: (i) blanket contractual liability, (ii) products, (iii) completed operations, and (iv) independent contractors coverage; (4) Automobile Liability with limits of $2 million each occurrence for bodily injury and property damage combined, covering all “owned,” “hired” and “non owned“ automobiles and including contractual liability coverage.

12. Indemnification

Customer will fully defend, indemnify, hold harmless and reimburse CRS, its officers, directors, shareholders, affiliates, subsidiaries, employees, agents, customers and assigns from and against all claims, suits, actions, proceedings, damages, losses and expenses, including attorneys’ fees, arising out of, related to, or resulting from: (a) any breach of any representation, warranty, certification, covenant or agreement made by Customer in the Agreement; (b) any act or omission or alleged act or omission of  Customer or its agents or subcontractors in connection with the Agreement; (c) any litigation, proceeding or claim relating to the obligations of Customer under the  Agreement; (d) any violation of law by Customer, its employees, agents, affiliates, contractors or subcontractors and (e) any third party claim.

13. Proprietary

Critical Rental, as a benefit to you, has developed the ideas and concepts detailed in all related, referenced, or attached proposals. These are considered by Critical Rental to be confidential and proprietary. These ideas and concepts remain the sole property of Critical Rental. Customers and end users acknowledge and agree to honor our proprietary right to the contents of this proposal and refrain from disclosing such content or any information to any third party, without the prior written consent of Critical Rental. Any unauthorized use of these ideas and concepts is strictly prohibited.
